3. REFUND POLICY
(withdrawal from a contract for the supply of digital content)
- The Store sells digital products (e-books / guides) delivered electronically and not on a tangible medium.
- Under Article 38(13) of the Act of 30 May 2014 on Consumer Rights (implementing Article 16(m) of Directive 2011/83/EU), the right to withdraw from a distance contract does not apply to digital content supplied electronically where performance began with the Consumer's express prior consent, the Consumer was informed that they would lose the right of withdrawal and acknowledged this, and the Seller provided confirmation of the contract on a durable medium.
- By placing an order, the Customer consents to delivery of the Digital Content before the withdrawal period ends and acknowledges that they thereby lose the right of withdrawal once the file is made available / download begins.
- In practice this means the purchased digital product cannot be returned for a refund once it has been made available. This does not limit the Customer's rights in respect of non-conformity of the Digital Content with the Contract.
- If the delivered Digital Content does not conform to the Contract (e.g. a corrupted file, inability to download, content different from that described), the Customer may submit a complaint to perfumifyeu@gmail.com. The Seller will bring the Digital Content into conformity, or — if that is impossible — the Customer may request a price reduction or withdraw from the Contract under Chapter 5b of the Act on Consumer Rights. Complaints are handled within 14 days.
